1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of the Stone offcut market website, applications, and related services (collectively, the "Service") operated by Stone offcut market ("we", "us", or "our").

By creating an account, signing in, browsing listings, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent that you meet this requirement.

If you use the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

3. Accounts and security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at info@stoneoffcutmarket.com if you suspect unauthorized access.

We may suspend or terminate accounts that provide inaccurate information, violate these Terms, or pose a risk to the Service or other users.

4. Marketplace role

Stone offcut market provides an online marketplace that connects buyers with sellers of stone offcuts, remnants, and related materials. Unless we explicitly state otherwise in writing, we are not the seller of listed products and are not a party to transactions between users.

Product descriptions, dimensions, photos, availability, pricing, and fulfillment arrangements are provided by sellers. You are responsible for reviewing listings and confirming suitability for your project before purchase.

5. Seller obligations

If you list products on the Service, you agree that you will:

• Provide accurate, current, and complete listing information, including material type, dimensions, condition, quantity, and location.
• Own the listed inventory or have legal authority to sell it.
• Comply with applicable laws, including consumer protection, weights and measures, and business licensing requirements in your jurisdiction.
• Honour confirmed orders and communicate promptly regarding pickup, fulfillment, or delivery arrangements.
• Complete required payment onboarding (such as Stripe Connect) before accepting online payments where applicable.

6. Purchases, payments, and billing

Online payments may be processed by third-party payment providers such as Stripe. By completing a purchase, you authorize us and our payment partners to charge your selected payment method for the order total, applicable taxes, fees, and subscription or credit charges disclosed at checkout.

Subscription plans, listing credits, and promotional pricing are described on the Service and may change from time to time. Unless otherwise stated, fees are non-refundable except where required by law or explicitly offered by us.

We may place holds, reverse transactions, or request additional verification where we suspect fraud, chargebacks, or policy violations.

7. Pickup, fulfillment, and risk of loss

Unless otherwise agreed between buyer and seller, risk of loss and title to physical goods transfer when the buyer takes possession at the agreed pickup or delivery location.

You are responsible for inspecting materials on receipt and raising disputes promptly through the channels we make available. Natural stone and engineered surfaces may vary in colour, veining, and dimensions.

8. Acceptable use

You agree not to:

• Use the Service for unlawful, misleading, or fraudulent purposes.
• Interfere with the security or operation of the Service, scrape data without permission, or attempt unauthorized access.
• Upload malware, infringing content, or false listings.
• Harass other users or our staff.
• Circumvent fees, payment flows, or access controls.

9. Intellectual property

The Service, including its design, branding, software, and content we provide, is owned by Stone offcut market or its licensors and is protected by intellectual property laws. You receive a limited, revocable, non-exclusive licence to use the Service for its intended purpose.

You retain ownership of content you submit, but grant us a worldwide, royalty-free licence to host, display, and promote that content in connection with operating the Service.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted or error-free operation, nor do we guarantee the accuracy of user-generated listings.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STONE OFFCUT MARKET AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Our total liability for any claim relating to the Service will not exceed the greater of (a) CAD $100 or (b) the amount you paid us in the twelve (12) months before the event giving rise to the claim, except where liability cannot be limited under applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Stone offcut market from claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your listings, your transactions, or your violation of these Terms or applicable law.

13. Suspension and termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms or if necessary to protect users, the public, or the Service.

You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including payment obligations, disclaimers, limitations of liability, and indemnification.

14. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.

You agree to the exclusive jurisdiction of the courts located in British Columbia, Canada, for disputes arising from these Terms or the Service, except where consumer protection laws in your province grant you non-waivable rights to bring claims elsewhere.

15. Changes

We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when they were last revised. Material changes will be posted on the Service. Continued use after changes become effective constitutes acceptance of the revised Terms.
